Representations, Petitions relating to Appointments

Representations may be made by applicants/candidates to the Commission in respect of a selection process which is still in progress .

Representations may be made (in writing) addressed to the Secretary of the Commission, on such issues as eligibility or non-eligibility of candidates, interpretation of eligibility clauses in the call for applications and equivalence of qualifications. Persons making such representations are to explain clearly the grounds for their representations and submit such supportive documentation as may be necessary for the Commission to consider their claim or complaint.

Petitions

After the result of a particular selection process has been published and an appointment made, the Commission will not entertain any representations from applicants/candidates but a petition may be made to the Prime Minister in terms of Section 1.1.10 of the Public Service Management Code which is reproduced hereunder:

1.1.10 Petitions Relating to Appointments and Promotions.

1.1.10 The following is the procedure for dealing with petitions relating to appointments or promotions in the Public Service which should be observed by heads of department and other officers whose duty it is to advise the Prime Minister on such petitions:

  1. If the petitioner is a serving officer, his petition is to be made through his head of department , who will transmit it to the Prime Minister through the usual channels with his comments.
  2. If the appointment has been approved by the Prime Minister on the recommendation of the Commission, the Prime Minister, in his discretion, may refer the petition to the Commission for advice. If the appointment has been made by the head of department under authority delegated to him, the petition will be dealt with on the Prime Minister's direction, unless the Prime Minister thinks fit to refer it to the Commission for advice.
  3. If the petitioner is not a serving officer, the petition is to be addressed to the Commission, where the appointment has been made by the Commission or to the head of department, where it has been made under authority delegated to him.
  4. If a request is made under (b) or (c) for an interview with the Commission, the grounds for the request should be stated for the consideration of the Commission.
