In terms of section 109 of the Constitution of Malta, the
Public Service Commission must consist of a Chairman, a Deputy
Chairman and from one to three other members.
Members of the Commission are appointed by the President
of Malta acting on the advice of the Prime Minister, given
after consultation with the Leader of the Opposition.

In terms of section 109 (6) of the Constitution,
a member of the Public Service Commission may be removed from
office by the President of Malta acting on the advice of the
Prime Minister, but he/she may be removed only for inability
to discharge the functions of his/her office or for misbehaviour.
Principles
In fulfilling its constitutional role and duties, the Commission
is guided by the following general principles and considerations:
the need
for an impartial public service with a high standard of
competence, efficiency and integrity;
justice,
fairness, impartiality and freedom from discrimination,
patronage or favouritism;
equal employment
opportunity;
recruitment
into the public service through fair and open competition;
